yea. turns out it was fraps itself, that was causing the problem.
is there a way to show in game FPS ? (without FRAPS)

You can now with Steam beta (Steam -> Settings -> Account -> Beta participation) show fps in a game (Steam -> Settings -> In-Game -> Show in-game frames/sec (FPS)) in the top left corner.
